1. Acceptance of Terms

These Terms of Service govern your access to and use of imagioo, an AI image generation platform available at https://imagioo.com. By creating an account, purchasing credits or subscriptions, generating images, uploading reference images, or otherwise using imagioo, you agree to these Terms.

If you do not agree to these Terms, do not use imagioo.

2. Service Description

imagioo provides tools for AI image generation, image-to-image creation, generated image history, image storage, downloads, subscriptions, and credit-based usage. imagioo may connect to third-party AI model providers, storage providers, payment providers, email providers, and infrastructure providers to deliver the service.

We may add, modify, suspend, or discontinue features at any time, including models, pricing, credit rules, storage behavior, and subscription options.

3. Accounts

You may need an account to use core features. You agree to:

  • Provide accurate and current account information
  • Keep your login credentials secure
  • Not share, sell, or transfer your account without permission
  • Notify us if you suspect unauthorized access
  • Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms, abuse the service, create security risks, or violate applicable law.

4. Credits, Plans, and Subscriptions

imagioo may use credits to measure AI generation usage. Credits may be granted through registration, daily login rewards, one-time purchases, subscriptions, promotional campaigns, or administrative grants.

Credit rules may include:

  • Different models, modes, resolutions, quality levels, or output counts may consume different credit amounts.
  • Credits may expire based on the plan, purchase, grant, or promotional rule.
  • Subscription credits may be granted for the current billing cycle and may not represent cash value.
  • Free or promotional credits may be changed, limited, revoked, or discontinued at any time.
  • Credits are not transferable unless we explicitly allow it.

Subscription plans renew automatically unless canceled before the next billing period. Canceling a subscription normally stops future renewal and does not automatically refund the current paid period unless required by law or clearly stated by us.

5. Payments, Billing, and Refunds

Payments may be processed by third-party providers such as Creem. By purchasing a plan or credits, you authorize the applicable payment provider to charge the selected payment method.

Unless otherwise required by law:

  • Completed purchases and subscription payments are generally non-refundable.
  • You are responsible for reviewing the selected plan, price, billing period, and credit amount before payment.
  • If a payment fails, we may suspend or limit paid features.
  • Taxes, currency conversion fees, card fees, or bank fees may be handled by your payment provider or financial institution.

6. User Content

"User Content" includes prompts, uploaded images, reference images, generated images, metadata, and other materials you submit, create, or manage through imagioo.

You retain any rights you already have in your User Content. You grant imagioo a limited license to host, store, process, transmit, display, reproduce, and create technical copies of User Content solely as needed to provide, secure, improve, and support the service.

You represent and warrant that:

  • You have the rights needed to upload, submit, and process your User Content.
  • Your User Content does not infringe intellectual property, privacy, publicity, or other rights.
  • Your User Content does not violate these Terms or applicable law.

7. Generated Images and Commercial Use

imagioo aims to support commercial-grade AI image creation. Subject to these Terms, the rules of the AI model providers, and applicable law, you may generally use generated images for personal or commercial projects.

However:

  • We do not guarantee that generated images are unique, non-infringing, trademark-safe, copyright-clear, or suitable for every commercial use.
  • Similar or identical outputs may be generated for other users.
  • Some third-party AI models may impose additional usage restrictions.
  • You are responsible for reviewing generated images before publication or commercial use.
  • You are responsible for obtaining any rights, permissions, releases, or clearances required for your specific use case.

imagioo does not provide legal advice regarding intellectual property, advertising, publicity rights, or commercial clearance.

8. Prohibited Content and Conduct

You may not use imagioo to create, upload, request, distribute, or facilitate content or activity that:

  • Is illegal, fraudulent, deceptive, or harmful
  • Exploits, sexualizes, or endangers minors
  • Promotes terrorism, violent extremism, or organized criminal activity
  • Creates non-consensual intimate imagery or sexual deepfakes
  • Harasses, threatens, doxxes, or targets individuals or protected groups
  • Impersonates others in a misleading or harmful way
  • Violates intellectual property, privacy, publicity, or contractual rights
  • Attempts to bypass safety systems, rate limits, access controls, or payment controls
  • Uploads malware, scripts, SVG payloads, or other harmful files
  • Abuses infrastructure, storage, bandwidth, AI providers, payment systems, or email services

We may block requests, remove content, suspend accounts, or refuse service when we believe content or conduct violates these Terms or creates legal, safety, security, or operational risk.

9. AI Output Limitations

AI-generated outputs may be inaccurate, unexpected, biased, incomplete, or unsuitable for your intended use. You should independently review outputs before relying on them.

imagioo does not guarantee:

  • Specific generation results
  • Model availability or response time
  • Continuous access to any third-party model
  • Permanent availability of every generated output
  • That generated content will be accepted by marketplaces, advertisers, platforms, or regulators

10. Storage, Downloads, and Deletion

imagioo may store generated images and uploaded reference images through object storage providers such as Cloudflare R2. Storage is provided for product convenience and history access, but should not be treated as your only backup.

You should keep independent copies of important generated content. We may delete or make content unavailable due to user deletion, account termination, abuse handling, storage failures, provider failures, legal requests, security incidents, or product changes.

11. Third-Party Services

imagioo relies on third-party services for AI generation, storage, payments, authentication, email, hosting, analytics, and related infrastructure. Your use of imagioo may also be subject to those providers' terms and policies.

We are not responsible for third-party service outages, policy changes, pricing changes, model changes, payment issues, or data processing practices outside our control.

12. Acceptable Use and Security

You agree not to:

  • Access or use accounts, images, subscriptions, credits, APIs, or systems without authorization
  • Probe, scan, attack, scrape, overload, or disrupt the service
  • Reverse engineer, bypass, or abuse security controls
  • Use automated requests in a way that harms service availability
  • Resell or provide access to imagioo as a competing service without permission
  • Use the service to violate law or third-party rights

We may enforce technical limits including authentication, rate limits, file type restrictions, file size restrictions, task concurrency limits, and abuse detection.

13. Intellectual Property

imagioo, including its name, logo, interface, software, configuration, documentation, design elements, and service infrastructure, is owned by us or our licensors. These Terms do not transfer ownership of imagioo or its underlying technology to you.

You may not copy, modify, distribute, resell, or exploit any part of imagioo except as allowed by these Terms or with our written permission.

14. Service Availability

We work to provide a reliable service, but imagioo may be unavailable or degraded due to maintenance, provider outages, network issues, abuse prevention, security incidents, infrastructure limits, or product changes.

We are not liable for loss of access, delay, failed generation, provider failure, unavailable images, or data loss except where liability cannot be excluded by law.

15. Termination

You may stop using imagioo at any time. We may suspend or terminate access if we believe you have violated these Terms, created risk, abused the service, failed to pay, or violated applicable law.

After termination, certain data may be retained where necessary for legal, security, accounting, dispute resolution, or compliance purposes.

16. Disclaimers

imagioo is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

You use AI-generated content at your own risk.

17. Limitation of Liability

To the fullest extent permitted by law, imagioo and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost content, business interruption, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim related to the service will not exceed the amount you paid to imagioo in the three months before the event giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless imagioo and its operators from claims, damages, liabilities, losses, costs, and expenses arising from your User Content, use of generated images, violation of these Terms, violation of law, or infringement of third-party rights.

19. Changes to These Terms

We may update these Terms from time to time. When changes are material, we may provide additional notice. Continued use of imagioo after changes take effect means you accept the updated Terms.
